Bivio Terms of Use

These Terms of Use ("Terms") govern your use of the Bivio application and related services (the "Service"). The Service is operated by Eugeniu Cozlenco, an individual based in Prague, Czech Republic ("Bivio", "we", "us").

By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service. We have tried to write these Terms so you can actually read them; headings help you navigate, and the full text of each section governs.

1. Eligibility and age

You may use Bivio only if you are at least 16 years old and can lawfully agree to these Terms. Bivio is intended for personal, non-commercial reflection.

2. Your account

You need an account to use Bivio. Provide accurate information and keep it current. One person per account. You are responsible for activity under your account and for keeping your sign-in credentials confidential; tell us promptly at hello@getbivio.app if you suspect unauthorized access.

You can sign in with an email address and password, or with Sign in with Apple. These are separate sign-in identities: an Apple sign-in is not automatically merged with an email/password account using the same address. If you use Apple's private relay email, keep relay forwarding active in your Apple ID settings — it is the address we use to reach you, including for account notices.

If you forget your password, you can request a reset from the app; the reset link returns you to Bivio to set a new password. Password resets never affect your Recovery Key or your encrypted records.

3. Your Recovery Key — read this one

Bivio encrypts the content of your decision records on your device. When you set up Bivio you receive a Recovery Key. Keep it somewhere safe and separate from your device; you can view it again in the app after confirming with Face ID or your passcode.

If you lose both your device's stored key and your Recovery Key, the sealed content of your records cannot be recovered by anyone, including us. That is a deliberate privacy design, and it has a real cost. We are not responsible for loss of access to encrypted records caused by a lost Recovery Key, except where liability cannot be excluded by law (Section 14).

4. What Bivio is

Bivio is a private decision-record and reflection tool. You record decisions before the outcome is known — typed or dictated — optionally with expectations, confidence, context, and alternative paths; you get a reminder to review; you close and rate the loop; and over time Bivio shows readings and possible patterns drawn only from your own records. A built-in Knowledge Center offers short educational entries about decision-making.

Bivio is a tool for your own thinking. You are responsible for the decisions you make and record. Nothing in the app — reminders, readings, lenses, or AI-assisted output — makes decisions for you or substitutes for your judgment.

5. Beta service

Bivio is currently offered as a free invited beta through Apple's TestFlight. That means, more than for most software: features may change, break, or be removed without notice; interruptions, bugs, and data-affecting defects are possible despite our care, so keep your Recovery Key safe; we may need to reset, migrate, or update the app in ways that require you to reinstall or sign in again; TestFlight itself is governed by Apple's terms, and beta builds expire; and we do not promise that the beta becomes a generally available product or that today's features survive into one. Nothing in this section takes away rights that consumer law gives you and that cannot be waived (Section 14). We genuinely want your feedback during the beta (Section 10).

6. Your content is yours

You own the content you create in Bivio — your decisions, notes, reviews, and everything derived from them for your use. These Terms transfer no ownership to us.

So that we can operate the Service, you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, transmit, process, and display your content — solely to provide and secure the Service for you, as described in the Privacy Policy. This includes sending the specific text or audio of a request to our service providers when a feature you are using needs it (for example, transcribing your dictation). The licence ends when the content is deleted, except for transient backup copies that age out as described in the Privacy Policy. We claim no right to use your content for advertising or to train AI models.

7. Voice, transcription, and AI-assisted features

Some features process your words with third-party AI services, through Bivio's own servers:

The Privacy Policy describes exactly what is sent, to which provider, and when — including two limits you should know: typing avoids audio transcription and the voice Smart Capture path but is not a guaranteed no-AI mode, and marking a decision Private excludes it from further AI processing but cannot undo processing that already happened earlier in the same capture. If a cloud step is unavailable, the app falls back gracefully and your words are kept.

8. AI output, readings, and their limits

AI-generated and rule-generated content can be incomplete, inaccurate, or plain wrong, and can misread what you said. Specifically:

Do not rely on any Bivio output as your sole basis for a significant decision.

9. No professional advice

Bivio does not provide medical advice, mental-health treatment, legal advice, financial advice, professional counselling, or any other regulated professional service, and nothing in the Service — prompts, readings, lenses, Knowledge Center entries, or anything else — should be read that way. If a decision has medical, mental-health, legal, or financial stakes, consult a qualified professional. If you are in crisis, contact local emergency services or a crisis line.

10. Feedback

If you send us feedback — through the in-app feedback sheet or otherwise — you grant us a perpetual, irrevocable, royalty-free licence to use it to improve the Service, without obligation to you. Feedback is stored and handled as described in the Privacy Policy; include a reply email only if you want an answer, and never include other people's confidential information.

11. Acceptable use

Use Bivio only for lawful, personal purposes. You must not: break the law using the Service or store content whose mere possession is unlawful; probe, scan, or breach the Service's security, or try to access other users' data; reverse engineer or extract source code, except where the law grants you that right despite this clause; scrape the Service, resell it, or use it to build a competing dataset; overload or disrupt the Service or evade its usage limits; misrepresent your identity to us; or use the Service to develop or train machine-learning models. We may investigate violations and take proportionate action under Section 13.

12. Intellectual property and the Knowledge Center

The Service — the app, its design, software, branding, the Patterns logic, and the original Knowledge Center writing — belongs to Bivio's operator or his licensors and is protected by intellectual-property laws. We grant you only the rights these Terms state and reserve the rest. "Bivio" and associated marks identify the Service.

The Knowledge Center contains general educational material about decision-making frameworks and thinking patterns. Bivio's claim covers its original descriptions, editorial organization, examples, and presentation — not the underlying public frameworks, methods, principles, or ideas, which belong to everyone. Entries are simplified by design, examples are illustrative, and no framework is promised to be complete, to reflect scientific consensus, or to fit your specific situation. It is not advice (Section 9).

13. Ending your account; suspension; changes to the Service

You can stop using Bivio at any time and delete your account in the app (You → Account → Delete account). Deletion is permanent and removes your account and records as described in the Privacy Policy.

We may suspend access where reasonably necessary to protect the Service or its users — suspected compromise, abuse, or material breach of Section 11 — limited to what the situation requires, with an explanation unless law or a genuine security need prevents it. We may terminate your account for a material breach you do not cure within a reasonable period after notice, or immediately for serious abuse. We may also discontinue the Service (a real possibility for a beta) with reasonable advance notice; where lawful and practicable we will give you an opportunity to retrieve your data before it is deleted.

We work to keep Bivio available and your data safe, but we do not promise uninterrupted or error-free operation, and reminders are not guaranteed to arrive. We may update the app and add, change, or remove features. Sections that by nature survive account closure (6, 10, 12, 14–16) survive it.

14. Disclaimers, liability, and your consumer rights

The Service is provided "as available." To the extent permitted by applicable law, and except as expressly stated in these Terms, we make no warranties — express or implied — about the Service, including fitness for a particular purpose, or that AI output, readings, or Knowledge Center content will be accurate or reliable.

To the extent permitted by applicable law: we are not liable for indirect or consequential losses, loss of profits, or loss of business arising from your use of the Service; for losses that are our fault, our total liability is limited to the greater of the amounts you paid us in the 12 months before the event (currently nothing — Bivio is free) and EUR 50; and we are not liable for loss of access to encrypted records caused by loss of your Recovery Key (Section 3).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited — including for death or personal injury caused by negligence, for fraud or intentional misconduct, or under mandatory consumer-protection law. If you use Bivio as a consumer, you keep every right the law of your habitual residence gives you that cannot be waived: under EU and UK law, digital content and services must conform to the contract and you have statutory remedies if they do not. This section applies only to the extent your local law allows, and these Terms do not require you to compensate us for anything beyond what mandatory law would already provide.

15. Apple App Store terms

Because you obtain the app through Apple's App Store (including TestFlight):

The licence to the app binary itself is granted under Apple's Standard Licensed Application End User License Agreement; in addition, we grant you a personal, non-transferable, revocable right to use the Service through the app on Apple-branded devices you own or control, as the App Store usage rules permit.

16. Governing law and disputes

These Terms are governed by the laws of the Czech Republic. If you are a consumer, this choice does not deprive you of the protection of provisions that cannot be derogated from by agreement under the law of your habitual residence, and you may bring or defend proceedings in the courts of your own country where that law allows. Otherwise, disputes go to the competent courts of the Czech Republic. These Terms contain no arbitration clause and no class-action waiver.

17. Changes and general terms

We may change these Terms as the Service or the law changes. For material changes we will give you advance notice in the app or by email at least 30 days before they take effect. Changes are not retroactive. If you do not agree, stop using the Service and delete your account before the effective date; continued use afterwards is acceptance. Where the law requires express consent to a change, we will ask for it.

If part of these Terms is held invalid, the rest remains in effect, and the invalid part is replaced by a valid provision closest to its intent. These Terms and the Privacy Policy are the entire agreement about the Service; this does not exclude liability for fraud or affect your statutory rights. You may not assign these Terms; we may assign them in connection with a transfer of the Service, provided the assignee honours your rights and we notify you. Not enforcing a provision is not a waiver. We communicate with you electronically — in the app and to the email on your account (including a private relay address) — and you agree that electronic notices satisfy any legal writing requirement, to the extent the law permits.
